For users in Quebec, the French version is the reference text. Version française

These terms apply when you choose Personal use: Cleartrill answering your own phone, for you and your household, not for a business. Personal use is offered in Canada and the United States. These terms, the Terms of Service and the Privacy Policy form one agreement between you and Diaz Industries Incorporated ("we", "us"). Where these terms and the Terms of Service differ, these terms prevail for your personal use. You accept them when you choose Personal use in the app or on the website, and the version you accept is stamped on your account.
Who can use it
A person 18 or older, for their own phone, for personal, family or household purposes. If you use Cleartrill for a business or a profession, choose what you do in Settings instead; the Terms of Service then apply on their own.
How the Terms of Service read for you
- The sentences that say Cleartrill is for businesses, and that you use it for your business and not as a consumer, do not apply to you. You use it as a consumer.
- Where the Terms say "your business", read "you". Where they speak of your callers or your customers, read the people who call or text you.
- The Spanish Términos de servicio are the reference text for businesses in Mexico. For personal use, these terms adapt the French Conditions d'utilisation in Quebec, and the English Terms of Service elsewhere.
What your assistant does
It answers when you cannot pick up, says it is an AI assistant and that the call is recorded, takes a message and sends it to you. It does not book appointments, quote prices or speak for a business. It never says where you are, whether you are home or when you will be back, and it never agrees to anything, confirms a payment or passes on a code in your name. It gives no medical, legal, financial or safety advice, and it is not an emergency service: it tells a caller in danger to call 911. In the United States it does not text people from your Cleartrill number, because carriers allow those texts only from registered businesses; you reply from your own phone.
Your callers' information
When you use Cleartrill for yourself, we are the organization responsible for the personal information of the people who call or text you. We use it only to give you Cleartrill: to take their message, send it to you and keep spam away. We never sell it, never use it for advertising, and never use recordings, transcripts or messages to train AI models. Calls are kept 90 days, then deleted, and you can delete a call sooner. This information is stored and processed in British Columbia and the United States. A caller can ask us to see, correct or delete the information from their call at support@cleartrill.ai. You use what you receive only for your own personal purposes.
Your rights as a consumer
The consumer protection law of your province, territory or state applies to you; in Quebec, the Consumer Protection Act. Nothing in these terms or in the Terms of Service takes away a right that law gives you and that cannot be waived, and where that law gives you more, it prevails.
Plans, renewals and cancelling
- The free trial needs no card, and nothing is charged when it ends.
- A plan renews at the end of each period until you cancel it. You can cancel at any time, online from Your plan in the app, with no cancellation fee; the plan runs to the end of the period you paid for and is not charged again.
- Before a plan paid 6 or 12 months ahead renews, we email you at least 30 days ahead with the date and the amount. Before a price changes, we email you at least 30 days before it applies to you.
- If you pay ahead on our website, you can ask for a full refund of that payment within 14 days of it. A purchase made in an app store follows that store's refund rules.
What does not apply to personal use
These parts of the Terms of Service are not part of your agreement for personal use:
- In "What we do not promise", the statement that Cleartrill is provided as it is and as available, with no warranty of any kind.
- "Your own risk, and no liability": the exclusion of all our liability, and its limit.
- "Release".
- "Claims against us because of your business".
- In "While Cleartrill is in testing", the sentence that the exclusions and the release apply in full during testing.
- In Canada, in "Disputes and law": talking first as a condition, the arbitration, its costs, the waiver of class actions and jury trials, "Many similar claims", and the courts of British Columbia as the only courts. In Quebec, also the choice of the laws of British Columbia.
In Quebec: the terms that do not apply
The Consumer Protection Act forbids certain terms in a contract with a consumer. These are the terms of the Terms of Service it covers; none of them applies to you.
- Does not apply to consumers in Quebec. In "What we do not promise", Cleartrill provided as it is, with no warranty.
- Does not apply to consumers in Quebec. "Your own risk, and no liability", including any limit on our liability.
- Does not apply to consumers in Quebec. "Release".
- Does not apply to consumers in Quebec. "Claims against us because of your business".
- Does not apply to consumers in Quebec. In "Disputes and law": "Governing law" (the laws of British Columbia), "Talk first" as a condition, "Arbitration", "Costs", "Individual claims only", "Many similar claims" and, in "Your right to opt out", the courts of British Columbia and the waiver of class actions and jury trials.
- Does not apply to consumers in Quebec. In "General", the way these terms change: "Changes" below replaces it.
In their place
Care. We provide Cleartrill with reasonable care and skill. An AI assistant can still mishear or get a detail wrong, so check what matters with the person who called. Where the law gives you a warranty or a guarantee, you have it.
Our responsibility. We are responsible to you as the law of your place provides.
Does not apply to consumers in Quebec. Where the law of your place allows it, we are not responsible for indirect loss, such as a lost opportunity, and our total responsibility is limited to the greater of what you paid us in the 12 months before the claim and 100 dollars in your currency. These limits never apply to fraud, wilful misconduct, gross negligence, or death or personal injury, and they apply only as far as your law allows.
Your use. You are responsible for using Cleartrill lawfully. If you use it to harass, deceive or harm someone, you are responsible for the harm that causes, as the law provides.
Disputes
In Quebec. The laws of Quebec and the federal laws of Canada apply. You can bring a claim before the courts of Quebec, including the Small Claims Division, and you can take part in a class action. You can write to us first at support@cleartrill.ai and we will try to resolve it, but you do not have to.
Elsewhere in Canada. You can write to us first at support@cleartrill.ai and we will try to resolve it, but you do not have to. You can bring a claim in the courts of the province or territory where you live, including its small claims court, or in the courts of British Columbia, and you can take part in a class action. The laws of British Columbia and the federal laws of Canada apply, together with the consumer protection law of your province or territory, which prevails where it gives you more.
Does not apply to consumers in Quebec. In the United States, "Disputes and law" in the Terms of Service applies as written: individual arbitration, the waiver of class actions and jury trials, and small claims court. You can opt out of arbitration by emailing support@cleartrill.ai within 30 days of accepting these terms. If the law of your state gives you a right that cannot be waived, you keep it.
Changes
We can change only these parts of these terms and of the Terms of Service: the service's features, its prices and fees, the allowances a plan includes, and the rules for using, paying for and cancelling it. At least 30 days and at most 90 days before a change applies, we email you a written notice, clear and legible, that sets out only the new clause, or the changed clause and the clause as it read before, the date the change applies, and your right to refuse it and cancel without cost, penalty or cancellation fee by telling us no later than 30 days after it applies. Outside Quebec, if you do not accept a change, you can also cancel before it applies, without charge.
Language
These terms are written in English, French and Spanish. In Quebec, the French version is given to you first and is the one that binds you, unless, after receiving it, you expressly choose to be bound by the English version; that choice is recorded on your account. Elsewhere, the English version controls unless the law of your place requires another version to prevail. The French and Spanish versions cost you nothing extra.
